These Terms and Conditions (“Terms”) govern your access to and use of the CRM software-as-a-service (“Service”) provided by RV5 LLC (“Company,” “we,” “us,” or “our”), through our website and platform. By creating an account, using our Service, or clicking “I Agree,” you agree to be bound by these Terms.

If you do not agree with these Terms, do not use our Service.

1. Eligibility

You must be at least 18 years old and capable of entering into a binding agreement to use the Service. By using our Service, you represent and warrant that you meet these requirements.

2. Account Registration

You must register for an account to access most features of the Service. You agree to:

Provide accurate and complete information
Maintain the confidentiality of your login credentials
Be responsible for all activities that occur under your account

You must notify us immediately if you suspect unauthorized use of your account.

3. Subscription and Payment

Use of the Service may require a paid subscription. You agree to:

Pay all applicable fees according to the pricing plan selected
Provide accurate billing and payment information
Authorize us to charge your payment method on a recurring basis

All fees are non-refundable unless otherwise stated.

4. Use of the Service

You agree to use the Service only for lawful business purposes and in accordance with these Terms. You must not:

Use the Service to violate any applicable laws
Upload, transmit, or store unlawful or harmful content
Attempt to interfere with or disrupt the Service or security measures
Reverse engineer, modify, or create derivative works based on the Service

5. Customer Data

You retain all rights to the data you upload or input into the Service (“Customer Data”). You grant us a limited license to use this data solely to provide and support the Service.

You are solely responsible for ensuring that your Customer Data complies with applicable laws, including data protection and privacy laws.

6. Intellectual Property

All content, features, and functionality of the Service (excluding your data) are owned by or licensed to Rv5 LLC and are protected by intellectual property laws. You are granted a non-exclusive, non-transferable, limited license to access and use the Service for your internal business use.

7. Service Availability

We strive to provide reliable and continuous access to the Service but do not guarantee uninterrupted availability. We may occasionally perform maintenance or updates that result in temporary downtime.

8. Termination

We reserve the right to suspend or terminate your account and access to the Service at our discretion, with or without notice, if you violate these Terms or misuse the Service.

You may cancel your subscription at any time, but fees already paid are non-refundable.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits or data, even if we have been advised of the possibility of such damages.

Our total liability for any claim related to the Service will not exceed the amount you paid to us in the past 12 months.

11. Indemnification

You agree to indemnify and hold harmless Rv5 LLC, its officers, employees, and agents from and against any claims, damages, losses, or expenses arising out of your use of the Service or violation of these Terms.

12. Modifications

We may modify these Terms at any time. We will provide notice of material changes by posting an update on our website or notifying you via email. Continued use of the Service after such changes constitutes your acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes will be resolved exclusively in the courts located in Volusia County.
